Registration

In order to use portions of this site, you must register with Lemons for Limes to open an account. As part of the registration process, you will need to enter an email address and password for your account. You will promise not select an email address and password with the intent to impersonate another person or use a password that Lemons for Limes, in its sole discretion, deems inappropriate or offensive. You are responsible for maintaining the confidentiality of your password and account. You are also fully responsible for all activities that occur under your email address, password or account. It is your sole responsibility to protect your password and to refrain from sharing your password with any other person. You understand and agree that you are liable for any activity performed by any people using this site under your account.

You must provide true, accurate, current and complete information about yourself when registering for any services on Lemons for Limes. If you provide any information that is inaccurate Lemons for Limes has the right to terminate your account.

 Member interactions

You agree to quietly pick up produce from the member's location that you are trading with and leave. You agree to never knock or ring the doorbell or initiate any type of communication with anyone at the home address of another member.

You understand the violation of the above may cause you to be removed from the website and you agree not to bring any litigation against Lemons for Limes, it's officers, shareholders, employees or other members if this occurs.

Rules and Obligations

You understand that all information or other materials are the sole responsibility of the person from which such content originated. This means that you, and not Lemons for Limes, is entirely responsible for all content that you upload, post, transmit or otherwise make available. Lemons for Limes does not control the content posted via this web site and does not guarantee the accuracy, integrity or quality of such content. The user posting any content must have all rights necessary to post such content, without violation of any intellectual property rights or any laws or regulations.

You understand that by using this site, you may be exposed to content that is offensive, indecent or objectionable. Under no circumstances will Lemons for Limes be liable in any way for any content made available via your individual account. You acknowledge that Lemons for Limes does not pre-screen content. Lemons for Limes has the right (but not the obligation) at their sole discretion to remove any content that is available on an individual post that violates this Terms of Use document or is objectionable or deemed as offensive. 3. Upload, post or otherwise transmit any content that is false, deceptive, misleading, deceitful, misinformative, fraudulent, or constitutes "bait and switch";  
4. Upload, post or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, rights of privacy or publicity, or other proprietary rights of any party  
5. Upload, post or otherwise transmit any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment  
6. Promote or provide instructional information about illegal activities, promote physical harm or injury against any group or individual. 
7. Upload, post or otherwise transmit any content that advertises any illegal service or the trade of any items which are prohibited or restricted by any applicable Federal or State law  
8. Take any steps to interfere with or in any manner compromise any of Lemons for Limes security measures  
9. Use Lemons for Limes for fraudulent purposes  
10. Attempt to decompile, reverse engineer, disassemble, modify or hack the Lemons for Limes website.  
11. Use Lemons for Limes to propagate "spam" email and/or computer viruses  
12. Contact anyone who has asked not to be contacted, or make unsolicited contact with anyone for commercial purposes  
13. Harass or "stalk" anyone  
14. Collect personal data about other users for commercial or illegal purposes  
15. Use an automated device or computer program that enables the submission of postings without each posting being manually entered by the author him or herself, including without limitation, the use of an automated posting device to submit postings in bulk, or automatically submit postings at regular intervals

Termination

You agree that Lemons for Limes, in its sole discretion, may terminate your use, password, and/or account, and remove and discard any content on your individual post for any reason, including, without limitation, that you have violated or acted inconsistently with Terms of Use document. Lemons for Limes reserves the right to terminate any account without prior notice. You acknowledge and agree that Lemons for Limes may immediately deactivate or delete your text, photos and any other pertinent data. Lemons for Limes reserves the right to bar any further access to this data. You agree that Lemons for Limes shall not be liable to you or any third-party for any termination of your access to the Lemons for Limes website.

When Lemons for Limes becomes aware of an alleged violation of this Terms of Use document, will initiate an investigation. During the investigation, Lemons for Limes may restrict a member's access in order to prevent further potentially unauthorized activity. Depending on the severity of the violation, Lemons for Limes may, at its sole discretion, restrict, suspend, or terminate a member's account and/or pursue other civil remedies. If a violation is a criminal offense, Lemons for Limes will notify the appropriate law enforcement authorities of such violation. Should criminally offensive violation take place, Lemons for Limes retains the right to communicate personally identifiable information to other interested parties in connection with law enforcement operations.

Subscription Fees / Refund Policy

Lemons for Limes charges subscription fees for each membership account. Lemons for Limes reserves the right to increase yearly subscription fees or to institute new fees at any time. The act of paying fees does not exclude you from the Terms of Use, which must be adhered to by all members.

Yearly subscription fees are charged up-front. Lemons for Limes does not provide refunds or credits for any subscription fees. Termination of any membership will not result in any refund or credit of fees already paid. The cancellation of a membership will go into effect when the next yearly fee becomes due. If we terminate your membership because you have violated these Terms, you shall not be entitled to the refund of any unused portion of fees or payments.

Exemption From Incurred Penalties and Liabilities

You agree to exempt Lemons for Limes from incurred penalties or liabilities from any alleged claim, including attorney fees, made by any third party regarding Lemons for limes or your produce or produce trade.

If there is a dispute between participants on this site, or between users and, or any third party, you understand and agree that Lemons for Limes is under no obligation to become involved. In the event that you have a dispute with one or more other users, you hereby release Lemons for Limes, its officers, employees, owners, agents and successors in rights from claims, demands and damages (actual and consequential) of every kind or nature, known or unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way related to such disputes and/or our service.

Transactions or Relationships Formed Between Users of This Site

Some material or information accessible in certain areas of Lemons for Limes  may be provided by other users and not by Lemons for Limes (including, for example and without limitation, advertisements for third party or user-provided products or services available on or through this site). You agree that Lemons for Limes shall not be liable to you or to any third party for any modification, suspension or discontinuance of this site.

Disclaimer of Warranties / Limitation of Liability

You agree that Lemons for Limes will not be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including injury, death, lost profit damages, loss of or damage to reputation or loss of information, arising from your use of the Services even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the disclaimer, exclusion or limitation of incidental or consequential damages, so the foregoing disclaimer, exclusion and limitation may not apply to you, and you may have other legal rights that vary according to jurisdiction. LEMONS FOR LIMES IS NOT RESPONSIBLE FOR THE DELETION, FAILURE TO STORE, MISDELIVERY OR UNTIMELY DELIVERY OF ANY INFORMATION.

ALL MATERIALS, INFORMATION, SERVICES INCLUDED ON LEMONS FOR LIMES WEB SITE ARE PROVIDED "AS IS," WITH NO WARRANTIES WHATSOEVER. LEMONS FOR LIMES DISCLAIMS ANY WARRANTIES REGARDING THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THE LEMONS FOR LIMES WEB SITE. Permitting and Taxes

Your final trade may require permitting through the United States Department of Agriculture (USDA), your individual state, regional, and/or local authorities. Lemons for limes makes no representations or claims regarding any required permits, licenses or regulatory compliance by buyers, sellers or traders. Each party is responsible for investigating and complying with the regulations that apply to them. Lemons for limes makes no representations or claims regarding any taxes or other fees levied by a government entity on a trade. Each party is responsible for complying with any tax requirement or other payment requirement of a government entity.

Quarantine Regulations

Lemons for limes does not promote and is not responsible for any violation of any Federal, State, or Local quarantine regulations by a trader. Lemons for limes does not control trades and therefore has no ability to regulate the individuals who utilize this site. Transporting produce, plants, or other products regulated under quarantine regulations is a violation of the law, please act responsibly. You also agree to investigate quarantine regulations that may be in effect in your area.

Use of Pesticides

State regulations vary regarding what pesticides may and may not be used. Lemons for limes does not control trades and therefore has no ability to regulate the individuals who utilize this site. Transporting produce, plants or other products where pesticides have been used may be in violation of the law, please act responsibly.  Lemons for limes is not responsible for any pesticide that may or may not have been used in connection with any trade.

Changes In Terms of Use

We may modify or terminate our services from time to time, for any reason and without notice, without liability to any user. We reserve the right to modify this Terms of Use document from time to time without prior notice. Please review this Terms of Use document from time to time so that you will be aware of any changes.
